Terms of service and end-user license
Last updated October 25, 2026
Who these terms are between
FastDragon LLC, a New Hampshire limited liability company ("FastDragon"), provides the FastDragon software. These terms apply to the company that subscribes to it (the "client") and to every person the client lets sign in. A signed order or agreement between FastDragon and the client governs where it differs from these terms.
The license
FastDragon grants the client a non-exclusive, non-transferable right to use the software for its own business during the subscription. The software, its code and its design remain FastDragon's. The client may not copy, resell, reverse engineer or rent it, or use it to build a competing product.
The client's data
Everything the client puts into FastDragon, or brings in from a connected service, belongs to the client. FastDragon holds it to run the software for that client and for no other purpose, and handles it as the privacy policy describes. Each client's records are kept in a database of its own. The client may export its data at any time, and for 30 days after the subscription ends.
Information that stays out
Social Security numbers, bank account and routing numbers, driver's license and other ID numbers, health information and passwords go into FastDragon only in a field built for that item. Card numbers never go in at all. Do not upload credit applications, personal guarantees, payment authorizations, voided checks, bank statements, W-9 forms, personal tax returns, copies of ID, driving records or medical certificates. Keep those in your own files. FastDragon may refuse, remove or mask this information wherever else it appears. If it is put in anyway, the client bears every cost that follows, including notices to the people it belongs to.
Uploaded files may be checked, converted, rebuilt or refused, and the stored copy may differ from the file sent, so keep your originals.
Accounts
The client is responsible for who it lets sign in, for what those people do in the software, and for keeping sign-in links, passkeys and devices secure. Tell us at once of any sign-in you did not authorize.
Connected services, including QuickBooks
FastDragon can connect to services the client chooses, such as Intuit QuickBooks Online, a truck telematics provider, or a text message service. A connection is made only when an authorized person at the client approves it on that service's own screen, and it can be removed from FastDragon or from the other service at any time. Through a connection, FastDragon reads and writes only what the feature needs, such as customers, products, invoices, payments and time entries. Access keys are stored encrypted. Removing the connection deletes them.
Each connected service is provided by its own company under its own terms. Intuit Inc. is not a party to these terms and is not responsible for FastDragon. FastDragon is not responsible for the availability or accuracy of another company's service.
Use the software lawfully
Do not use FastDragon to break the law, to send messages people did not agree to receive, to probe or overload it, or to reach another client's data.
Fees
Fees are as stated in the client's order or agreement. FastDragon may suspend access to an account more than 30 days past due after giving notice.
Records are the client's to check
FastDragon calculates and files from what the client enters. The client is responsible for reviewing its books, tax returns and filings before relying on them or submitting them. FastDragon is software, not an accountant, tax preparer or lawyer.
Warranty
FastDragon will provide the software with reasonable skill and will work to correct errors reported to it. Beyond that, the software is provided as is, without other warranties, including any implied warranty of merchantability or fitness for a particular purpose.
Limit of liability
Neither side is liable to the other for indirect, incidental or consequential damages, or for lost profits. FastDragon's total liability for any claim is limited to the fees the client paid in the twelve months before the claim arose.
Articles and guides on this website
This section applies to every visitor to fastdragonsoftware.com. The articles, guides, glossary entries, tables and worked examples on the website are general information about the fuel business, written for a general audience. FastDragon gives no legal, tax, accounting, engineering or compliance advice through them, and reading them creates no client or advisory relationship. Rules change, and states, cities and agencies often add their own. Each article that states a rule shows the date it was last reviewed and links the sources it relies on. Confirm the current rule with the agency that enforces it, or with your attorney or tax advisor, before you act. The content is provided as is, without any warranty of accuracy, completeness or fitness for a particular purpose, and FastDragon is not liable for any loss arising from reliance on it. Worked examples use invented businesses and figures unless a source is named.
What the client promises
The client confirms that it has the right to put its data into FastDragon and to connect the services it connects; that the people and companies it sends texts and emails to through FastDragon have agreed to receive them; and that its use of FastDragon follows the laws that apply to its business, including fuel tax, transportation and consumer laws.
Indemnity
The client will defend and hold FastDragon harmless against claims by others that arise from the client's data, the client's use of the software in breach of these terms, or the client's filings, invoices, messages and dealings with its own customers, suppliers, drivers and government agencies.
Figures from other sources
Prices, tank levels, truck positions, driver hours, bank and card files, and records from connected services come from the client and from other companies. FastDragon shows them as received and does not guarantee they are complete, current or correct.
Confidentiality and security incidents
Each side keeps the other's non-public business information confidential and uses it only to carry out these terms. If FastDragon learns that a client's data was accessed without authorization, it will tell the client without undue delay and say what it knows.
Events outside anyone's control
Neither side is responsible for a delay or failure caused by events beyond its reasonable control, such as an outage at a hosting, internet or connected service provider, a natural disaster, or an act of government.
Ending the subscription
Either side may end the subscription as the client's order or agreement provides. On ending, access stops, connections to other services are removed, and the client's data is available for export for 30 days and then deleted, except where the law requires us to keep it.
Changes
FastDragon may update these terms. The date above shows the latest version. A change that reduces the client's rights takes effect 30 days after notice to the client.
Law and disputes
These terms are governed by the laws of the State of New Hampshire. Any dispute is heard only in the state or federal courts located in New Hampshire, and each side agrees to those courts' jurisdiction. Claims may be brought only individually, never as part of a class or representative action.
The rest of the agreement
These terms, together with the client's order or agreement and the privacy policy, are the whole agreement on this subject. If any part is found unenforceable, the rest still applies. Not enforcing a term is not a waiver of it. The client may not transfer its rights without FastDragon's written consent; FastDragon may transfer these terms with its business. The sections on the client's data, indemnity, liability, confidentiality and disputes continue after the subscription ends.
